Report: Court of Appeal Grounds of Judgment for the Case Concerning the Bukit Cherakah Forest Reserve and the Shah Alam Community Forest in Particular

On 24 January 2024, the Court of Appeal dismissed the appeal by two NGOs, namely Pertubuhan Pelindung Khazanah Alam Malaysia (PEKA) and the Shah Alam Community Forest Society (SACF Society), against the decision of the High Court concerning the degazettement of part of the Bukit Cherakah Forest Reserve.

Circa May 2025, the grounds of judgment of the Court of Appeal were published. There are two judgments, namely the majority judgment by YA Azizah binti Nawawi and the minority judgment by YA Wong Kian Kheong, where both judgments dismiss the appeal.

Due to their public importance, the judgments are published here to enable the public to access them.
